Facts:
Following the running of Race 8, the McDONALD EXCAVATING MOBILE PACE, an Information instigating a Protest (13730) was laid by Stipendiary Steward Mr N Ydgren, alleging that under rule 869 (8) (b) with approximately 600 meters to run Elmer Fudd (K N Larsen) shifted ground inwards forcing Guns N Roses (N P Williamson) over pylons with a pylon dislodging causing Ask McArdle (K L Barclay ) to break.
The Protest was by Horse no. 8 placed 5th by the Judge, against horse No.6 placd 2nd by the Judge.

Stipendiary Steward Mr N Ydgren used video film to illustrate the incident that caused Mrs Barclays horse 'Ask McArdle' to break.
Mrs Barclay, driver of Ask McArdle stated that she was travelling 3 deep trailing Guns N Roses when a pylon became dislodged and hit her horse, causing it to break.
Mr Williamson (Guns N Roses) stated that he had Mr Larsen (Elmer Fudd) travelling outside him and that they were travelling in extremely tight quarters. Mr Williamson confirmed that he had indeed struck the pylon, causing it to dislodge. He maintained that it was caused by the downward movement of Mr Larsen and that the racing was extremely tight.
Mr Larsen confirmed this fact by stating that he had nowhere to go. He said that he had sulky wheels hard up on both sides of him, allowing him no room to adjust sideways. He believed that the general tightening of this group was caused by pressure on his outside, namely by the horse El Nino (7) driven by Mr A Armour. Mr Larsen used both the side on and back on video films to illustrate his points.
Mr Ydgren stated that it was clear that Mrs Barclay had lost considerable ground in this incident and that her chances were taken away. Mr Ydgren went on to state that it was difficult to see on the film what caused the tightness. Mr Larsen repeated that he had no room and that there was extreme pressure on both sides, this was confirmed by Mr Beck who was trailing Mr Larsen when the inside horse (Ask McArdle) broke.
Mr Kilkelly (Trainer of Ask McArdle) stated that it was obvious that his horse was disadvantaged by the incident.
Reasons for Decision:
The Committee considered all the evidence presented very carefully. The Committee found that Mrs K Barclay's horse broke and lost considerable ground as a result of hitting a pylon, through no fault of its own. The Committee could also see that the horses were in very tight quarters and that there was little, if any, room for Mr Larsen (Elmer Fudd) to manoeuvre. The Committee also felt that Horse No7 (El Nino) driven by Mr Armour may have contributed to the tightening. The Committee also felt that the video film was inconclusive and agreed with Mr Kilkellys suggestion that the TAB be approached in an attempt to improve the filming of this stage of a race.
