As Mr Bosson admitted the breach the charge of careless riding was found proved.
Penalty:
Mr Bosson is suspended from the close of racing today, August 27th, up to and including racing on Sunday September 11th. This equates to 7 riding days as we have not included South Canterbury on September 2nd.
Charge:
Following the running of Race 8, the New Zealand Bloodstock Insurance Premier, an Information was lodged by Mr C George against Mr O Bosson alleging a breach of Rule 638(1) (d).The Information stated that passing the 300m O Bosson the rider of TWILIGHT SAVINGS permitted his mount to shift out when not clear of SANTANGELO which was taken out into the line of GEEZA which was severely checked.
Facts:
Mr George asked Mr Goodwin to show the films and explain the incident. Mr Goodwin identified Mr Bosson riding TWILIGHT SAVINGS back in the middle of the field. He was surrounded by horses with no clear run available to him. Mr Bosson was then seen to angle his horse outwards forcing Mrs Allpress (SANTANGELO) out of the way. She in turn dictated the line of GEEZA causing that horse to be badly checked .The rear view video clearly showed Mr Collett having to take evasive action. Mr Bosson then went on to win the race.
Submissions for Penalty:
Mr George produced Mr Bosson’s riding record which showed two charges of careless riding in the previous 12 months. He stated that the actions of Mr Bosson were at the high end of carelessness and the consequential effects were severe. He said that GEEZA was “lucky to stay up” following the incident. The Stewards’ penalty submission was for a period of suspension of between six and eight days.
While Mr Bosson freely admitted the breach he said that Mrs Allpress’s mount reacted far more than he had anticipated it would. He asked the committee to take into consideration that he was struggling with weight at the moment and that a suspension would make that even more difficult for him. He also advised that he had no firm riding commitments within the next seven days so could begin any suspension immediately. In response to a question from the committee Mr Bosson said that he only rode regularly in the Central Districts and Northern regions.

In coming to a decision on penalty the committee considered all of the submissions. We adopted a starting point of five days suspension. Mitigating factors for Mr Bosson were his admission of the breach and his good record however aggravating factors were his determination to force a run when there was insufficient room to do so, the resultant interference to Mrs Allpress and Mr Collett and the critical stage of the race where it all took place. While Mrs Allpress suffered some interference Mr Collett (GEEZA) was severely affected. This must be reflected in penalty. Mr Bosson found himself held up with nowhere to go and instead of waiting for a run he created his own space at the expense of two other runners. SANTANGELO may have moved out further than expected but Mr Bosson was the instigator of that movement. In the opinion of the committee his actions outweighed any of the mitigating factors.
