Accordingly, Mr Mudhoo’s license is suspended from the close of racing today, Saturday, July 4th, 2020 up to and including racing on Saturday July 11th, 2020.
Facts:
Following the running of Race 10 (BJW Motors/ Rayner Building 1400), an Information was lodged by Mr Goodwin alleging a breach of Rule 638(1)(d) in that A Mudhoo caused interference in the home straight.
Mr Mudhoo confirmed his understanding of the charge and his admission of the breach. Mrs Clapperton was present to assist him.
Films of the incident had been viewed several times during the protest hearing that preceded this charge. Mr Goodwin highlighted the four horse-width gap between Mr Mudhoo’s mount and Mr Johnson’s horse before Mr Mudhoo commenced to shift inwards. Mr Goodwin said Mr Mudhoo only straightened his horse after the interference occurred.
Mr Mudhoo said he was satisfied with Mr Goodwin’s description of the incident. He was on a long rein and while he was aware of the eventual winner to his inside, he did not see Mr Johnson in behind. It was only after Mr Johnson called out to him that he realised this and straightened up.
Ms Clapperton said that Mr Mudhoo’s mount had wandered inwards, and it was only when he used the whip that it ducked in sharply on the last stride, causing interference.
Submissions for Penalty:
Mr Mudhoo has had 35 rides and no charges preferred against him. Mr Goodwin described the breach as low end and said the Stewards did consider a warning however submitted that a suspension was more appropriate.
Mr Mudhoo advised that he did not have any riding commitments in the next 7 days therefore any suspension could begin immediately.
Reasons for Penalty:
The Committee considered all submissions.
Mr Mudhoo’s actions of careless riding resulted in a significant check to Mr Johnson’s mount and a protest hearing brought by the trainer Mr Vile.
Although Mr Mudhoo did try to straighten his mount up his actions were too late and he continued to ride forward while drifting in. It was the opinion of the Committee that a suspension was an appropriate penalty.
Mitigating factors were Mr Mudhoo’s inexperience, his clear record and admission of the breach. The restriction on racing as a result of Covid 19 must be taken into account. The current racing calendar provides fewer opportunities for riders and this has been reflected in penalty.
Balancing up all factors, it was our opinion that a suspension of 2 days was appropriate.
