As Ms Collett admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Ms Collett’s suspension pursuant to Rule 1106(2).

Accordingly, Ms Collett had her license to ride in races suspended for a period to commence after racing on 26 August and conclude after racing on 2 September 2018.

Facts:

Following the running of race 4, NZB Insurance Pearl Series Race, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that Ms Collett allowed her mount XPRESSION to shift in when not sufficiently clear of THE REAL BEEL which was checked inside the final 50 metres.

Ms Collett said that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Jones demonstrated the incident using the available video footage. He said that Ms Collett allowed her mount to shift in when only 1 length clear of THE REAL BEEL. As a result that runner was checked just short of the finish line. He said in mitigation there was some slight outward movement from SANTA CATARINA and MOHAKA which were racing on their inside.

Ms Collett said that Mr Waddell, the rider of THE REAL BEEL, took a hold 2 strides before the finish line. She said that she had gone past THE REAL BEEL earlier in the home straight and was unaware that the horse was racing 1 length behind her. She freely conceded that her corrective action was too late to avoid causing the interference.

Submissions for Penalty:

Mr Coles said that Ms Collett had about 1200 rides last season and she had not been charged for careless riding. He said this was an excellent record for which Ms Collett should be given credit. He described the level of carelessness as low end and submitted that a suspension would be an appropriate penalty.

Ms Collett advised that she had upcoming engagements in Japan this weekend and sought a deferment to any proposed suspension until after racing on 26 August. She said the level of interference was minor.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

When reviewing the video footage the Committee observed that Ms Collett permitted her mount to shift into the running line of THE REAL BEEL just short of the finish line. At the point of interference Ms Collett was 1 length clear of THE REAL BEEL which was checked. The head on footage showed that SANTA CATARINA shifted out into the line of MOHAKA just prior to the finish line. However, this incident had minimal bearing on THE REAL BEEL being checked. The Committee deemed the level of carelessness displayed by Ms Collett was low range.

The JCA Penalty Guide starting point for low range carelessness is 6 national riding days.

There were no aggravating factors.

The mitigating factors were Ms Collett’s admission of the breach and her unblemished record in the last 12 months. It is significant to note that NZTR records show Ms Collett had 1173 rides last season which was 400 more rides than her nearest rival in the premiership. For these collective factors Ms Collett was afforded a 2 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 4 days.
