The charge is admitted and is therefore upheld.

Penalty:

I impose a fine of $200.00 on Mr Ritchie.

Facts:

Following the running of the NZB INSURANCE PEARL SERIES RACE an Information was lodged by Stipendiary Steward, Mr A Coles against Licensed Class A Trainer, Mr S Ritchie alleging that DEVERSTATION was presented to race with shoes that were not approved.

Mr Ritchie was not present at the hearing but through his representative, Mr J Bragg he admitted the breach.

Rule 613(d) provides that " a person must not start or attempt to start a horse in a race or a trial - unless fully shod with approved plates in accordance with the plating provisions of the approved gear list determined and published by NZTR in accordance with Rule 609 , provided that in exceptional circumstances a Stipendiary Steward may permit a horse to run unshod or partly shod ".

Stipendiary Steward, Mr M Williamson produced one of the shoes that DEVERSTATION was wearing and it was an ordinary shoe and not a racing plate.

Mr Williamson also said that Mr Ritchie was not at the meeting but in a telephone call to him Mr Ritchie had said that he could not offer any excuse apart from the fact that he had a new Foreman. He is aware of the need for horses to be in racing plates but there was no reason why DEVERSTATION was presented in shoes and he therefore admitted the charge.

As a result of the error DEVERSTATION was late scratched from the race.

Submissions for Penalty:

Mr Coles said that there had been prior decisions under this Rule and he said that an experienced professional trainer had been fined $200.00 for such an offence.

In this instance the horse was late scratched from the race and this affected the Club running the meeting.

Reasons for Penalty:

In assessing penalty I have considered the mitigating factors which are Mr Ritchie's admission of the breach and also his good record.

The aggravating factors however are that from an error that should not have happened the late scratching of DEVERSTATION affected the owners of the horse and affected the betting turnover upon which the Club depends. It had a considerable affect on an already depleted race.

I have been told of a $200.00 fine imposed on another trainer for this offence and taking into account the above factors and also the need to maintain consistency I believe that a similar fine is appropriate in this instance.
