Charge:

Following the running of Race 4, the Bluewater Hotel Premier, an Information was lodged by Mr C George alleging a breach of Rule 638(3) (b) in that jockey K Smith the rider of CRIXUS used his whip unnecessarily when his mount was out of contention.

Facts:

Mr George showed CRIXUS racing in last place as the field rounded the bend for home. Mr Smith used the whip on the horse, behind the saddle, at regular intervals down the final straight for the duration of the race. Mr Smith was never in contention and finished 11.9 lengths from the winner.

Submissions for Penalty:

Mr George produced Mr Smith’s riding record which showed no previous breaches of this rule. He stated that it was a Premier race day with a large number of people watching and this display of unnecessary whip use was “not a good look”. He submitted that a fine of $200 was an appropriate penalty.
Mr Smith told the committee that he had not hit his horse continuously but did concede that he had used the whip more than was necessary.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions including Mr Smith’s clear record and his admission of the breach. It was our opinion that Mr Smith’s use of the whip was completely unnecessary. After trying the whip early in the home straight CRIXUS failed to respond but Mr Smith continued to use the whip at regular intervals despite tailing the field. The committee explained to Mr Smith that unnecessary whip use will not be tolerated or accepted. This was a showcase race meeting with a larger than normal viewing audience.
