The Committee was satisfied that Mr Orange had driven carelessly in allowing his horse to strike the sulky wheel of MYSTIC REIGN. The Committee also noted Mr Orange’s admission of the breach.

 

Penalty:

Mr Orange was fined the sum of $200.

Facts:

Following the running of Race 2, Glenferrie Farm Handicap Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Driver, Mr B N Orange, alleging a breach of Rule 869 (3) (b) in that Mr Orange, as the driver of JARVSOFAKS in the race, drove carelessly when attempting to shift down the track with approximately 300 metres to run resulting in his drive striking the wheel of MYSTIC REIGN (M Purdon)”.
 
Mr Orange had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information.
 
Rule 869 provides as follows:
(3) No horseman in any race shall drive:-
    (b) carelessly.

 

Submissions for Decision:

Mr McIntyre showed video replays of the incident with approximately 300 metres to run. He pointed out Mr Orange, driving JARVSOFAKS, racing back on the markers with Mr Purdon, driving MYSTIC REIGN, outside of and just ahead of Mr Orange. At that point, Mr Purdon attempted to move outwards and Mr Orange attempted to shift in. The off front leg of JARVSOFAKS contacted the sulky wheel of MYSTIC REIGN and the horse broke. MYSTIC REIGN also went off stride. Mr Purdon told the Stewards that, just prior to the incident, his horse had been trotting roughly and he did not blame Mr Orange for his horse breaking. It was an error of judgement on Mr Orange’s part, Mr McIntyre said.

 

Submissions for Penalty:

Mr McIntyre informed the Committee that in the 2009/2010 season Mr Orange had 659 drives and, in the current season to date, has had 111 drives. Mr Orange had no previous breaches during those periods. Mr McIntyre submitted that, having regard to Mr Orange’s excellent record and his admission of the breach, a fine of $200 was appropriate.

Reasons for Penalty:

In determining penalty, the Committee had regard to Mr Orange’s admission of the breach and his excellent race driving record. The Committee assessed the degree of carelessness as low to mid and accepted that Mr Orange had made an error of judgement.
