As the careless riding charge preferred against Mr McNab was admitted it was deemed to be proved by the Judicial Committee.
Penalty:
Mr McNab’s Jockeys Licence was suspended from the close of racing on 3 January 2017 up to and including 13 January 2017 (5 days). The committee had regard for the fact that one Premier race meeting was included in the term of suspension.

Facts:
Following the running of race 8 (Laser Plumbing Te Puke City of Auckland Cup), Information No. A8660 was filed with the Judicial Committee. Mr Oatham alleged that near the 2200m Mr McNab allowed his mount ZAMBEZI WARRIOR to shift in when not sufficiently clear of ZAFRENZY which was forced in, crowding SNOW SECRET with MARCIANO also being hampered.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be (d) careless.
Mr McNab advised the committee that he understood the Rule and confirmed that he admitted the breach.
Stipendiary Steward, Mr Williamson showed four different film replays and said that as the field linked up with the running rail ZAMBEZI WARRIOR was racing approximately 6 horses off the fence. He said that Mr McNab then allowed ZAMBEZI WARRIOR to shift in and crowd ZAFRENZY who went in onto SNOW SECRET and MARCIANO. He said that Mr McNab did attempt to relieve the pressure but that he had got in too far before any pressure was relieved and that the damage had been done. He added that Mr McNab had shifted in on a reasonably sharp angle.
Mr McNab, for his part, said that he had put minimal pressure on ZAFRENZY and that the interference to SNOW SECRET and MARCIANO was not his doing. He added that he admitted tightening ZAFRENZY but that that did not have anything to do with the check to SNOW SECRET and MARCIANO.
Submissions for Penalty:
Mr Oatham said that Mr McNab had four previous breaches of careless riding during the past 12 months with the latest being on 18 November 2016 when a 5-day suspension was imposed. He said that Mr McNab’s record over the last one to two years had been of some concern to the Stewards, but that there had been signs of improvement and that he (McNab) has been making an effort to improve on that record. He submitted that on this occasion Mr McNab’s record be considered as a neutral factor. He added that the Stewards had a different view of the incident to that of Mr McNab. He said that the Stewards placed the level of carelessness below mid-range as he went just one stride too far.
Mr McNab in response said that it was low-range interference and reiterated that his shift did not result in the interference to SNOW SECRET and MARCIANO. He added that he rode throughout the North Island and sometimes in the South Island.
Mr Rodley advised the Judicial Committee of the upcoming riding engagements for Mr McNab and said that he would not be riding at Reefton or Hokitika.

The aggravating matters were that the incident occurred in a Group 3 Race with a total stake of $200,000 and that three horses were affected. It was considered by the Committee that Mr McNab’s record was below average.
The mitigating factors were the admission of the breach and the low to mid-range carelessness.
The JCA starting point for careless riding is one of 5 riding days suspension and due to the aggravating matters alluded to that was uplifted to one of 6 days. The committee gave an allowance of one day for the mitigating matters.
