It was ruled that “Lucy Holmes” was eligible to start in Race 3.
Facts:
Prior to the commencement of this race meeting Stipendiary Steward Mr S. P. Renault filed an Information requesting a ruling in relation to Race 3, the Just Rose & Brian Fawdray Fillies & Mares Pace.
The Information reads as follows:
“I the above named informant seek a ruling in relation to Rule 822(3)(a) from the Judicial Committee – to make a ruling as to whether Lucy Holmes is eligible to start in Race 3 after its name was left out of the field in the on course race book.”
Rule 822(3)(a) provides as follows:
“(3) Notwithstanding that a horse may have been duly entered and accepted or deemed to have been accepted for a race in accordance with these Rules, such horse shall not be eligible to start in such race if;-
(a) its name does not appear in the Official Race Card relating to such race:”
Submissions for Decision:
Mr Renault gave evidence that it had been discovered that “Lucy Holmes” (11) had been omitted from Race 3 in today’s on course race book. A check of the TAB and HRNZ web sites showed that this horse had been included in the field published by them, and also the newspapers and racing publications had included this horse. It was also established that at the time of this hearing bets had already been placed on “Lucy Holmes” off course.
The on course race book printer would have obtained the fields from a web site, and it appears that a mistake was made in printing this field, with the last horse in the race (“Lucy Holmes” (11)) being omitted.
Mr Renault submitted that “Lucy Holmes” was correctly entered for Race 3 and should be allowed to start. If this was ruled on course patrons would be advised of the omission in the race book.
Reasons for Decision:
We were satisfied that “Lucy Holmes” was correctly entered for Race 3 today. There is no definition in the Rules for “Official Race Card” and it is our view that the “Official Race Card" is the fields released by HRNZ on its web site, and that the on course race book is a copy of that. For these reasons we were satisfied that “Lucy Holmes” was eligible to start in Race 3 today.
