Facts:
Mr. AJ Butcher did not admit a breach of rule 869 (2) (c) in that as the driver of Sharapovas Delight he projected his whip outside the confines of the sulky on several occasions in the run home.
Submissions for Decision:
Mr. Taumanu using the films, showed the committee the incident. He pointed out the whip was projected well out and could have caused problems for horses travelling behind. He believed the whip was extended much further than normal on about 6 occasions.
Mr. Butcher told the committee he really only rolled his wrists and flicked the horse a few times. Not other horses were affected.
Reasons for Decision:
Having looked at the films and considering the rule and guidelines, the committee finds that the rule has been breached.
Submissions for Penalty:
Mr. Taumanu asked for a fine in the vicinity of $300. Mr. Butcher had been charged and fined $150 under this rule on the 31/10/10.
Mr. Butcher had no comment.
Reasons for Penalty:
Although concurring the rule was breached, the committee is of the opinion that the incident was relatively minor, no other horses were affected and Mr. Butchers drive was behind the place getters and racing in the clear.
