Following the running of Race 7 (DUNSTAN HORSE FEEDS MOBILE PACE 2200m) Information No. A11105 was filed with the Judicial Committee. It was alleged that Mr Butcher drove carelessly when striking a sulky wheel near the 700m losing all chance.
Mr Butcher acknowledged that he understood the Rule, the Charge and confirmed that he admitted the breach.
Mr Mulcay showed film replays and said that Mr Butcher had improved 3-wide near the 700m and as he attempted to slot into the 1x1 position he made an error in striking the outside wheel of MACH LITTLE SOAKY and broke up losing all chance.
Mr Butcher said that he thought he was okay but that he made a slight error of judgement.

Mr Mulcay said that Mr Butcher had a clear record. He added that the aggravating factor was that his drive THE LONE RANGER lost all chance, with the mitigating features being a clear record, admission of the breach and that no other runner in the race was affected.
Mr Butcher reiterated that it was an error of judgement only and asked that his record be considered.
Reasons for Penalty:
After considering all of the aforementioned and the JCA Penalty Guideline, it was determined that a $200 fine was a suitable sanction.
