As Mr Asano has admitted the breach, it is found to be proved.

Penalty:

In these circumstances, the penalty submission of the informant is accepted. Mr Asano is fined the sum of $100 and ordered to forfeit his riding fee.

Facts:

Mr Davidson alleged that in race 5 the NZB INSURANCE PEARL SERIES RACE 1200m Mr Asano incorrectly attached the leathers to his saddle which then became detached during the preliminary, resulting in WHITNEY being declared a late scratching.

Mr Davidson demonstrated that the saddle in question was in good condition. He explained that the respondent had attached the leathers to his saddle incorrectly.

Mr Asano confirmed this saying it was some six months since he had last used a small saddle, such as this, and he had not used one very often prior to that. Mr Walsh said it was an error on Mr Asano’s part.

Submissions for Penalty:

Mr Asano has no previous breach of this or any related rule. Mr Davidson submitted a small fine and forfeiture of the respondent’s riding fee was appropriate on this occasion. Both Mr Walsh and Mr Asano agreed with this submission.

Reasons for Penalty:

This is a rare breach of the rules. It was fortunate that the incident did not occur during the running of the race. The horse was late scratched so the investments on WHITNEY were refunded but the connections lost the opportunity to race their horse and had the cost of bringing it south to the meeting. Mr Asano is an inexperienced apprentice and is remorseful.
