Facts:
At the conclusion of race 2 The Grinaldi Lodge Two Year Old Fillies Pace a protest was lodged by Stipendiary Steward Mr C J Allison under rule 869(8)(a) and (b), alleging that the first placed horse by the judge BOOTIE BROMAC (K Larsen), hung inwards over the final stages locking wheels with BELLA STARR (N Williamson).
Rule 869(8)(a) and (b) reads:
The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses,-
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

Stipendiary Steward Mr C Allison used the various video clips to highlight the final stages of the race, showing that with approximately 50 metres to run, BOOTIE BROMAC (K Larsen) hung inwards on BELLA STARR (N Williamson) causing Mr Williamson to take hold of his horse.
The video evidence also highlighted the fact that these two horses did lock wheels, confirming Mr Williamson’s progress was impeded.
Mr Williamson said that he did not contribute to the incident and stated that once he got into the passing lane and balanced up, he continued to make inroads into BOOTIE BROMAC’s lead, and that just before contact was made his horse was going well enough to win.
Mr Larsen (BOOTIE BROMAC) conceded that his horse did run in, but felt he always had BELLA STARR covered and that the incident just short of the winning post made the margin tighter than it should have been.
Reasons for Decision:
The Committee were satisfied having viewed the video evidence, that contact had occurred and that this was caused solely by the inward movement of BOOTIE BROMAC.
Mr Williamson’s evidence was also persuasive in that he was clearly impeded from from finishing closer and at that stage had got to within a neck of the leader.
The winning margin being confirmed as a neck.
