As the breach was admitted we find the charge proved.
Penalty:
Placing emphasis on the mitigating factors we believe a 1 day reduction from the starting point of 5 days is appopriate. Accordingly we impose a suspension on Mr Hills which will commence after racing on 19th March and conclude after racing on 26th March 2011(4 riding days).

Facts:
Mr George alleged that Mr Hills (BOB VALDER) permitted his mount to shift outwards near the 300 metres when not sufficently clear of READ MY LIPS (V Colgan) which was checked.
Submissions for Decision:
Mr Oatham demonstrated the head on and side on films of the incident.This showed BOB VALDER moving out at the 300 metres while under pressure when not clear of READ MY LIPS who was crowded and checked.
Mr Hills when asked had nothing to say.

Mr George said Mr Hills had a very good record with one previous charge for careless riding in the last 12 months.He said the carelesness was in the mid range and Mr Hills was a busy North Island rider.
Mr Hills said he had firm commitments at Te Rapa on March 19 and requested a deferment of his suspension.

The committee carefully considered all evidence and submissions presented. Mitiating factors are Mr Hills very good record and his admission of the breach. However the aggravating factor is he moved out into the line of READ MY LIPS when not clear.
