Following the running of Race 8, Mico Plumbing Handicap Trot, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Driver, Mr I R Cameron, alleging that Mr Cameron, as the driver of BRIGHT GLOW in the race, “used his whip on more occasions than allowed under the whip regulations in the last 400 metres of the race”.
Mr Cameron had signed the Statement by the Respondent on the information form indicating that he admitted the breach. Mr Cameron was present at the hearing of the information and he confirmed that he admitted the breach.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.
The Use of Whip Regulations (effective from 30 November 2017) provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Renault showed a video replay of the final 400 metres of the race. He pointed out Mr Cameron, driving BRIGHT GLOW, which was racing in 5th position passing the 400 metres, but beginning to improve around other runners. Stewards were alleging that Mr Cameron had used his whip in a striking motion sixteen times from the 400 metres to the finishing line, Mr Renault said. This included a number of backhanders, approximately 6-7. A number of “little flicks” were not included in the count. This was “the high end of mid-range”, Mr Renault submitted.
Mr Cameron accepted the number of strikes alleged by the Stewards and said there was nothing else he could say.

Mr Renault told the Committee that Mr Cameron had 51 drives last season and tonight’s drive was his second for the current season. He had breached the whip rule on 25th November 2018 (Motukarara, fined $200) but the six months reset period applied.
Stewards were seeking a fine of $300, being the penalty prescribed in the Regulations for a first offence breach involving a number of strikes in the range of 14-16, Mr Renault said.

The penalty prescribed in the Regulations for a first breach, as this is deemed to be, in the range of 14-16 strikes, is a fine of $300. In this case, there are no aggravating or mitigating factors requiring an uplift or a discount. The Regulations call for a fine of $300 for this breach.
