Accordingly after taking all the above factors into account we uphold the protest and the result shall now be as follows:

1st      2 WAR HORSE

2nd     8 ROLL OUT THE CARPET

3rd    10 SILK PINS

4th    11 SORIANO

5TH    3 TRAVINO

Therefore the committee orders the payment of dividends and stakes as listed above.

Facts:

The offical margin between 1st and 2nd was 1/2 a head and the protest hearing started at 4.38 pm.

The Judge's placings were as follows:

1st   8 ROLL OUT THE CARPET

2nd   2 WAR HORSE

3rd   10 SILK PINS

4th   11 SORIANO

5TH   3 TRAVINO

Following race 7 an information was filed pursuant to rule 642(1).  The informant Mr Bridgeman alleged that ROLL OUT THE CARPET placed 1st by the judge interferred with the chances of his runner WAR HORSE placed 2nd by the judge.  He alleged this interference occurred in the final straight.

Submissions for Decision:

Mr Bridgeman demonstrated the video films and pointed out to the hearing ROLL OUT THE CARPET shifting out on 3 occasions in the final straight. He submitted that this clearly obstructed his runner WAR HORSE as his line was severely dictated. Mr Bridgeman said WAR HORSE ran on strongly after this interference to finish within 1/2 a head of ROLL OUT THE CARPET at the line. He said he was adamant that WAR HORSE would have won the race if he had had clear running to the post.

Mr Bosson, rider of WAR HORSE, said at the 270 metre mark he ranged up to ROLL OUT THE CARPET when suddenly that horse moved out dictating his line. He said he was bumped which forced him to come back across the heels of ROLL OUT THE CARPET. Mr Bosson said he was almost stopped in his tracks and was in no doubt that he would have won the race if he had not suffered interference.

Mr McVean, co-trainer of ROLL OUT THE CARPET, conceded his horse did move out but said this was a result of birds on the track causing his horse to shy and move sideways.

Mr McDonald, rider of ROLL OUT THE CARPET, admitted he did duck out sharply at the 200 metres.  He said this put his horse off balance and it was a big effort to get up and win.  Mr McDonald said all the other runners had their chance to beat his mount.

Mr George when asked for his appraisal of the protest said it was clear there was significant interference to WAR HORSE and because of the margin at the post submitted the protest should be upheld.

Reasons for Decision:

The committee carefully considered all evidence and submissions as presented and reviewed the video films several times.  It was clearly evident that WAR HORSE'S line was dictated which necessitated Mr Bosson having to stop riding on 2 occasions.  He then finished strongly from being 1 length behind ROLL OUT THE CARPET at the 100 metres to finish within 1/2 a head of the winner at the post.  For those reasons the committee is satisfied that WAR HORSE would have beaten ROLL OUT THE CARPET if interference had not occurred.
