As Mr Sissons admitted the charge, we find it proved.
Penalty:
We impose a fine of $250 and remind Mr Sissons of his obligations under the Rules of Harness Racing.
Facts:
Mr Allison, Stipendiary Steward, alleged that in race 1 the BISHOPDALE & BUSH INN TAB’S/TAVERN HAREWOOD AMATEUR DRIVERS MOBILE PACE, Mr Sissons (GLACIER EXPRESS) drove carelessly near the 400 metres and 250 metres when shifting ground outwards checking ROCK OF TARA (A White).
Mr Allison demonstrated on the videos that Mr Sissons twice moved wider on the track when Mr White was to his outside and when Mr White had Ms Blake to his outside. Mr White was forced to take hold of ROCK OF TARA.
Mr Sissons said he had admitted he had shifted ground but he still believed ROCK OF TARA was not racing that well at the time and that Mr White was not close up behind the horse that he was following.
Submissions for Penalty:
Mr Allison produced the respondent’s record, which was clear under this Rule. He said Mr Sissons had been co-operative with the Stewards and had admitted the breach. However, he emphasised there were two incidents and that these had resulted in the relegation of GLACIER EXPRESS. He submitted a fine of $250 was appropriate.
Mr Sissons emphasised this was his first breach of this Rule and he had had over 200 amateur drives. He did not disagree with Mr Allison’s submission as to penalty; although he pointed out he had lost stake money as a consequence of the relegation.
Reasons for Penalty:
We are satisfied that the breach is mid-range and a distinct aggravating feature is the fact that GLACIER EXPRESS was relegated with a resulting loss for those who invested on the horse. We take into account the respondent’s excellent record and his admission of the breach.
