As Mr Bradley has admitted the charge it is therefore deemed to be proved.

Penalty:

Mr Bradley is suspended from race riding from the conclusion of racing on Saturday 30th March until the conclusion of racing on Wednesday 4th April 2012. He will therefore not be able to ride at Auckland or Palmerston North on 31st March, Paeroa on 2nd April, Banks Peninsula on 3rd April and Pukekohe on 4th April 2012.

Charge:

It was alleged that the Mr Bradley shifted ground outwards forcing "Fashion Rocks" on to "Hell Yeah" which forced "The Pearler" out on to "Fly Silca Fly" which was forced across the running of "Irish Jewel" which was checked.

Facts:

Mr Ray showed the Committee video coverage of the incident which gave rise to the charge. He showed the Committee how Mr Bradley, on his mount was racing 4 to 5 horse widths off the rail with about 350 metres to run for home. Mr Bradley moved out quite sharply from his position behind other horses and in the process made some contact with "Fashion Rocks". The consequence of this contact was a "concertina" effect, forcing other horses outwards as outlined in the information. The most notably effected was "Irish Jewel" which had to be checked by its rider. It was quite clear that Mr Bradley was not his own horse length and another horse length when he made his outward movement.

Submissions for Penalty:

Mr Ray told the hearing that Mr Bradley was a busy rider who rode throughout New Zealand regularly. He further said that Mr Bradley had a good record and had not been charged in the last 12 months with careless riding. He observed that the race was a Listed Stakes Race, but also noted that Mr Bradley had been co-operative with the Stipendiary Stewards and had admitted the charge at an early opportunity.

He submitted that a 6 day suspension was an appropriate penalty.

In response, Mr Bradley said that he was a careful rider generally, but did acknowledge that he was not his own horse length and another length clear when he made his move and for that reason, admitted the charge at an early opportunity. He acknowledged that a suspension was appropriate. He confirmed to the hearing that he had not been charged puruant to this rule in the last 12 months. He made application for a 7 day suspension of the coming into effect of any period of suspension imposed.

Reasons for Penalty:

In this Committee's opinion, the degree of carelessness was at the lower end of the scale. The impact on the eventual placings of the horses affected, was not, in this Committee's opinion, that great.

Our starting point for penalty is a suspension of 5 riding days. Because of the fact that this was a Listed Stakes race, an uplift of 1 day is justified, making the suspension that of 6 days. However, against that, we give Mr Bradley credit for his good record, his  early admission of the charge and his co-operation with the Stipendiary Stewards. Mr Bradley was going for a discernible gap, but made a mis-judgement in the process. These factors are mitigating factors which enable us to provide a discount of 2 days off our starting point.

Mr Bradley's application for a deferment of the coming into effect of the penalty is granted. He has satisfied us that he has actual and potential riding engagements at Wanganui and Awapuni in the next 7 days.
