We exercise our discretion and TRICKY GIRL is relegated to behind SUNNIVUE BAY BOY.
Amended placings are:

Facts:
At the conclusion of Race 9, the ODT JUNIOR DRIVERS PACE, an information was lodged by Mr Allison, Stipendiary Steward, under r 869(8)(b) alleging that with approximately 500 metres to run TRICKY GIRL (Mr M Purvis) which was placed 2nd by the Judge hung inwards tightening SUNNIVUE BAY BOY (Ms K Butt) which lost its position.
Judge’s placings were:
1ST 5 VERA’S DELIGHT
2ND 8 TRICKY GIRL
3RD 1 GOSHAWK
4TH 10 SPECIAL DELIGHT
5th 3 TANGO LADY
The official margins between 4th and 5th and 5th and 6th were a head and a head.
Rule 869(8)(b) provides:
The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
Ms K Butt, assisted by Mr J Cox, represented the connections of SUNNIVUE BAY BOY.
Mr M Purvis, assisted by Mr M Williamson, represented the connections of TRICKY GIRL.
Submissions for Decision:
Mr Allison, Stipendiary Steward, demonstrated on 2 video angles that as the horses came off the back straight TRICKY GIRL hung in and the wheel of her cart was in front of Ms Butt impeding SUNNIVUE BAY BOY’s progress. A further 20 metres later TRICKY GIRL hung in again and Ms Butt had to take hold. Contact was made and SUNNIVUE BAY BOY broke briefly. Mr Allison stated that SUNNIVUE BAY BOY lost its position in the race to which it was entitled and that Ms Butt had had to pull back. He believed she would have otherwise have raced forward of where she was in the field. He emphasised that SUNNIVUE BAY BOY had finished on strongly down the outside of the track and was only a head and another head away from 4th.
Ms Butt stated she was racing 3 wide and Mr Purvis was 4 wide on the top bend. She said Mr Purvis’ horse had started to lay in and she had had to grab hold and restrain her horse. On the second occasion there was contact and her horse had broken and lost momentum. She said had she not suffered interference she could have received the run in the race that Mr Purvis received. She said her horse had run on strongly over the final stages. She confirmed she had had to restrain her horse twice and had lost her position in the field. She said she had not received any pressure from her inside and her horse did not contribute to the incident. She observed her horse had had a tendency to lay in over the final stages.
Mr Cox stated that carts had come together and that Mr Purvis’ wheel was under that of Ms Butt. He said SUNNIVUE BAY BOY had lost momentum and its position in the field. He emphasised the narrowness of the margin between 4th and 6th.
Mr Ashton, the trainer of SUNNIVUE BAY BOY, said the horse had received a cut on its hind leg during the running and he believed that was why it had hung in over the concluding stages.
Mr Purvis stated that Mr Veint had pushed Ms Butt wider on the track and that was why there had been contact between the carts.
Mr Williamson acknowledged TRICKY GIRL had hung in but said Ms Butt had had the opportunity to hunt up behind Mr Purvis but had not been able to go forward and that was why Mr Veint had come out and taken her spot.
Reasons for Decision:
The Committee is satisfied that the outwards movement by Mr Veint which pushed Ms Butt wider on the track was prior to TRICKY GIRL hanging in. TRICKY GIRL, which was racing 4 wide, moved down on the track not once but twice with SUNNIVUE BAY BOY, which was 3 wide, losing momentum on both occasions. SUNNIVUE BAY BOY lost its position in the field as a consequence. We believe that the fact that Ms Butt was not close up behind Mr Purvis, thus allowing Mr Veint, who was 2 wide, to take advantage of her loss of momentum and move wider on the track, was because her horse had broken from its gait and had become unbalanced for a time.
Significantly SUNNIVUE BAY BOY, which lost its position in the field, finished on strongly at the finish and was only a head and a head from 4th. We are satisfied that SUNNIVUE BAY BOY suffered interference on 2 occasions as a result of inwards movement from TRICKY GIRL. Both the progress and chances of SUNNIVUE BAY BOY were affected as a consequence.
