As the breach was admitted we find the charge proved.
Penalty:
Accordingly and under the provisions of rule 1106 (2) (a) we suspend Miss Johnson from riding in races from after racing on 6 October and concluding after racing on 18 October 2012 (6 days). We have not taken into account Invercargill on 12 October or Waimate on 15 October as Miss Johnson could not confirm she was riding at those meetings.

Facts:
Following race 2 an information was filed pursant to rule 638 (1) (d). The informant Mr Oatham alleged that Miss D Johnson permitted her mount SHUKA to shift inwards when not sufficiently clear crowding FARAWAY EYES on to CIVICS ROCK and TIME LEGEND which were all checked over the concluding stages.
Submissions for Decision:
Mr Robinson demonstrated the video films which showed SHUKA racing wide out on the track in the final stages of the race. Mr Robinson said SHUKA was inclined to lay in but Miss Johnson continued to ride forward. He admitted she did stop using the whip momentarily but then continued again which resulted in her mount ducking in sharply causing severe interference on her inside. Mr Robinson submitted that Miss Johnson had a warning that her mount was going to shift in but she took the gamble and continued to ride forward.
Miss Johnson said that it was evident on the films what had happened and admitted she had hit her mount one stride too many. She said her mount was green which did not help and the incident was made to look worse by FARAWAY EYES coming up onto her horse's hind quarters.

Mr Oatham produced Miss Johnson's record which showed three breaches in the last twelve months although it was six months since her last charge. He submitted today's breach was in the mid to high range with three horses receiving severe interference.
Miss Johnson said she had commitments up to and including 6 October.
Reasons for Penalty:
The committee has carefully considered all evidence and submissions as presented. It was obvious that Miss Johnson had been given a warning her mount was going to move in but the mistake she made was to continue to ride forward with the whip. The consequences were 3 horses received severe interference and 2 riders were nearly dislodged. We find Miss Johnson's carelessness to be in the mid to high range. We have taken into account Miss Johnson's admission of the breach and her record which we consider average.
