Mr J Oatham alleged that Mr G Cooksley permitted his mount ROMAN TOIA to shift inwards near the 1100 metres when not sufficiently clear of DEL TORO (T Thornton) which was checked.
Submissions for Decision:
Mr Coles demonstrated the video films and pointed out to the committee ROMAN TOIA racing in a 3 wide position approaching the 1100 metres. He then showed Mr Cooksley allowing his mount to shift in and into the line of DEL TORO when only a bare length clear. He said this caused Miss Thornton to take a hold of her mount and lose ground as a result.
Mr Cooksley admitted it was an error of judgement in that he moved in when the pace had slackened and consequently was not sufficiently clear.

Mr Oatham said Mr Cooksley had an excellent record with no charges in the last 12 months. He said in this case it was an error of judgement on Mr Cooksley's part and submitted it was at the low end of carelessness.
Mr Cooksley said he had commitments until after racing on 12 February 2011.

The committee carefully considered all submissions and evidence as presented. Mitigating factors are Mr Cooksley's outstanding record with this charge actually being his first in the last 4 years. He also admitted the breach. The committee is satisfied that Mr Cooksley's carelessness is at the lower end. When considering the appropriate suspension from a starting point of 5 days the mitigating factors are most relevant. For the reasons outlined above the committee determines that a discount of 2 days from the starting point is appropriate in this case.
