As the breach was admitted we find the charge proved.
Penalty:
Accordingly we impose a suspension on Mr Razali which will commence after racing on the 16th February and conclude after racing on 23 February 2011 (5 riding days).
Charge:
Mr Coles alleged that Mr Z Razali (ANNE’S SELECTION) near the 200 metres allowed his mount to shift in when not sufficiently clear of GOTTINO (C Grylls) which was checked.
Facts:
Mr Oatham demonstrated the video films which showed near the 200 metres Mr Razali's mount had shifted in 3 horse widths when being ridden forward with the whip. He said the horse had given Mr Razali prior warning when shifting ground earlier in the straight. Mr Grylls was forced to check his mount severely to avoid heels.
Mr Razali and Mr McRae when asked had nothing to say.
Submissions for Penalty:
Mr Coles said Mr Razali’s horse shifted ground and at no stage did he stop pushing forward. He believed the check Mr Grylls received was quite significant. He told the committee this was Mr Razali’s first charge for careless riding. He submitted a suspension of 4-6 days taking into account his admission and the level of interference.
Mr Razali said he had commitments at Ellerslie on the 16th of February 2011.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. Mitigating factors are his admission of the breach, his excellent record. The aggravating factor was that Mr Razali continued to ride forward with the whip. He should have stopped riding and straighten up his mount to avoid the significant interference it caused to Mr Gryll’s mount.
The committee explained to Mr Razali the starting point for careless riding is 5 days.
