As Mr Bothamley has admitted the breach, it is found to be proved.

Penalty:

Mr Bothamley is suspended from riding at the end of the meeting today up to and including 5 March 2015. This is one South Island day.

Facts:

Mr Davidson alleged that Mr Bothamley failed to make the declared weight for LIFE’S IN A SPIN in race 7, the SPEIGHTS PUBLICAN’S PLATE RATING 65 1400m, and was replaced.

Rule 330(3)(c) provides:

(3) A Rider shall not: …

 (c) fail to ride a horse at the weight at which it is handicapped to carry….

Submissions for Decision:

Mr Davidson stated that Mr Bothamley had come to the stipendiary stewards early in the day and had stated he was unable to make the weight for LIFE’S IN A SPIN. He said the connections had been able to obtain a suitable replacement rider.

Mr Bothamley stated that access to a sauna was difficult in light of the amount of travelling Canterbury jockeys had had to do in the past 3 days.

Submissions for Penalty:

Mr Davidson stated that Mr Bothamley’s previous breach of this Rule was only a week ago when he was fined $100. He said that due to Mr Bothamley’s financial situation the Committee might consider a one day’s suspension.

Mr Bothamley stated he was not in a position to pay a fine and he believed a one day’s suspension was fair.

Reasons for Penalty:

Mr Bothamley had only one ride today and has been unable to make the weight. To his credit, he informed the stipendiary stewards at the first opportunity. We are aware that Mr Bothamley has ongoing issues with his weight.

We accept the submission from both parties that a suspension is appropriate in the particular circumstances of this case.
