On resuming the hearing, it was ruled that “MR CHROME” be declared a late scratching in this race.
Facts:
Following the running of Race 7, the Rangiora New World Nat Hall Memorial Handicap Pace, an Information requesting a ruling was filed by Stipendiary Steward, Mr N M Ydgren. The Request for a Ruling was made pursuant to Rule 213(1)(j) as to whether “MR CHROME” (11), had been denied a fair start when the tapes were released.”
The Information reads as follows:
“I the above named informant seek a ruling in relation to Rule 213(1)(j) from the Judicial Committee as to whether MR CHROME was denied a fair start when the tapes were released.”
Rule 213(1)(j) reads as follows:
“(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:-
(j) if a horse is denied a fair start and such occurrence materially prejudiced the chances of that horse.”
Submissions for Decision:
Mr Ydgren gave evidence, and used video coverage to show that “MR CHROME” was the only starter on the 30 metre mark. The barrier strand was being hand held by a starter's assistant, and when the start was declared, there was a delay in this strand being released. It could be seen that “MR CHROME” was square on to the barrier strand at the time the other barrier strands were released, but because of the delay, the horse was restrained, taken side on, and missed the start. It was established that “MR CHROME” finished 5th in this race, the margins being ¾ length, a neck, ¾ length and 1¾ length. Mr Ydgren was not convinced that this incident affected the chances of “MR CHROME”.
There was evidence from Trainer Mr A D Stuart, and Driver Mr T S Chmiel, that “Mr CHROME” is usually a quick beginner, and Mr Chmiel estimated that the horse lost about 10 metres because of this incident. Both Mr Stuart and Mr Chmiel agreed that this incident affected “MR CHROME'S” chances of finishing in a dividend bearing place.
We adjourned to consider our decision.

We carefully considered the video coverage and the evidence, and we were satisfied that the delay in releasing the barrier strand materially affected the chances of “MR CHROME” finishing in a dividend bearing place (1st to 4th), and that it should be declared a late scratching.
