Alleged that Mr Smith was late presenting two starters, namely "Regal Light" and "Prince of Gems" into the birdcage and onto the racetrack.
Facts:
Mr Smith had two starters in Race 1, the "One Over Da Moon Trot". The timetable for the day's racing required horses to be in the birdcage for Race 1 at 12:10 pm for a race start time of 12:25 pm. "Prince of Gems" was presented 4 minutes before race start time and "Regal Light" one minute before race start time.
Submissions for Decision:
Mr Wallis told the hearing that this breach of the rules was normally dealt with by a Minor Infringement Notice. However, Mr Smith had two previous breaches of this rule, namely in January 2013 and in June 2013 and thus it was necessary in terms of the Rules to proceed by way of Information as a more substantial penalty is required in cases of repeat offending.
Submissions for Penalty:
Mr Wallis submitted that a fine of $300 should be imposed. He said that Mr Smith had been fined $100 on the two previous occasions that he had breached the rule.
Mr Smith acknowledged that he was late, and said that he thought the race start time was 12:25 pm. He also said that one of his staff did not arrive at the track. He said that he had asked Stipendiary Stewards at Blenheim in late June, if he could present both horses later than the programmed time because both horses had problems with "tieing up". Mr Wallis acknowledged that permission was asked for a late presentation of the horses but said that is was made clear to Mr Smith that 5 minutes before race time was the "cut-off" point.
Mr Smith also thought that a fine of $300 was a "bit steep".
Reasons for Penalty:
Mr Smith has admitted the charge at an early opportunity and we give him credit for that. However, the aggravating feature in this case is that two horses were presented late by Mr Smith and it is the third occasion in the current racing season that Mr Smith has breached the rule. The fine to be imposed must reflect that.
