Facts:
Following the running of the NRM HANDICAP TROT an Information was filed by Senior Stipendiary Steward Mr JM Muirhead against the 5th placing of ALL OVER THE STARS on the grounds that it broke and galloped in excess of 50 metres in the final 200 metres of the Race.
Rule 870(3) provides: any horse which breaks from its gait shall promptly regain its proper gait.
Part B of the Breaking Horses Regulations provides: any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.
Trainer/Driver Mr TA Cameron advised the Committee that he did not contest the Protest. Mr Cameron did not wish to attend the Hearing.
Mr Muirhead demonstrated the incident by use of the race films and showed where ALL OVER THE STARS broke in the home straight and galloped for approximately 100 metres.
Submissions for Decision:
Mr Muirhead submitted that as ALL OVER THE STARS had breached Rule 870(3) it should be disqualified from the race.
