Due to the Committee’s finding the protest 6th against 5th was upheld.

The placings now read:

Authorization was given for prize money to be paid on the amended placings.
 

Facts:

Following the running of Race 6 (Grant Plumbing Wellington Steeplechase) an Information was filed with the Judicial Committee.

The Information read:

Interference at the last fence alleging MR DEEJAY placed 5th by the Judge interfered with JACK ROMANOV placed 6th by the Judge.

Judge’s Placings:

3rd Tom’s Myth
4th No Quota
5th Mr Deejay
6th Jack Romanov

The margin between 5th and 6th placings was a nose.

Rule 642(1) reads:

If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

Submissions for Decision:

Neither of the parties were present as Mr K Duncan the Trainer of MR DEEJAY had said that after viewing the films of the incident that he would not be contesting the protest and that he did not wish to be present at the hearing.

Reasons for Decision:

All films were shown to the Committee and they all showed that MR DEEJAY ran the last fence down significantly and as a consequence of this action severely interfered with JACK ROMANOV. JACK ROMANOV was observed to lose all momentum as a result of the interference, he then recovered extremely well to finish in 6th placing, only a nose behind MR DEEJAY. The Committee was satisfied that if interference had not occurred to JACK ROMANOV that it would have beaten MR DEEJAY.
