Playboy has clearly been denied a fair start and is therefore declared a non-runner.
Facts:
Mr Whiterod using the head and side on films showing the start of race three, presented evidence to the committee of the ‘release’, that is the gates opening, in particular horses in barriers six (PACTUS) and seven (PLAYBOY). Immediately after the gates have opened PLAYBOY, being hampered and leaving the start slower than the rest of the field, then settling in last place. Replayed, the films clearly show on leaving the barrier PACTUS has jumped awkwardly and leans out heavily on to the partition on it’s outside between it and PLAYBOY. The partition moves outwards and into the space partially closing the barrier of PLAYBOY, forcing that horse to push it’s way out and slowing it’s momentum at the start and losing ground on the rest of the field.
Mr. Tinsley the rider of PLAYBOY asked the committee to observe the partition between PLAYBOY and PACTUS move in and onto him immediately after the start. This has leant in and made contact with his body and he has had to push his way out and it has cost him at least one length or more and he has had to settle at the back of the field. Having won on the horse at its last start where it raced handy to the lead it was the intention on this occasion to do the same but believes he has lost that opportunity and has been denied a fair start.

Reasons for Decision:
Rule 632;
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of the starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non starter.
On reviewing the films both head and side on carefully and taking into account the evidence presented by both the Stipendiary Steward and Mr Tinsley, it is clear that PLAYBOY was inconvenienced at the start when the dividing partition of the stall inside PLAYBOY has leaned over onto PLAYBOY to such an extent that it prevented that horse an equal opportunity to start with the rest of the field.
