"Propitious" is declared a non starter, in terms of Rule 632 and bets are to be refunded.

Facts:

At the start of Race 6, the "RD Petroleum Rating 65", "Propitious" (M Cameron) was drawn in barrier position 6. When the starter released the starting stalls, the gate to barrier position 6 was slow to open, and in the process, "Propitious" was hampered. Mr Cameron told the hearing that he lost several lengths at the start.

Video coverage of the incident was shown to the hearing which confirmed Mr Cameron's account of the situation.

Submissions for Decision:

Stipendiary Steward Mr McLaughlin submitted that there had been a mechanical failure of the starting stalls which had interfered with the chances of "Propitious" getting a fair start. The gate was still partly closed when the rest of the gates opened.

Reasons for Decision:

The evidence clearly satisfied the Judicial Committee that there had been a mechanical failure of the gate to barrier position 6 which  just did not open simultaneously with the rest of the gates. "Propitious" did not finish in the first three placings. It was not slow away of its own accord. It was the clear view of the Judicial Committee, that the horse was denied a fair start, and having regard to the amount of ground lost by the horse, the occurrence materially prejudiced the chances of the horse. Thus, in terms of the discretion to be exercised in considering the Stipendiary Stewards' request, this Judicial Committee has no hesitation in declaring "Propitious" to be a non starter.
