Accordingly for the reasons above we find the charge proved.

Penalty:

Accordingly after taking all the above into account we impose a suspension of Mrs Thornton's license to start after racing on 1 August and conclude after racing on 9 August (5 days).

Facts:

Following race 6 an information was filed pursuant to rule 638 1) (d). The informant M J Oatham alleged that Mrs T Thornton permitted her mount ZAHTUI to shift inwards near the 1800 metres when not sufficiently clear of SHOOTING DAGGERS which was taken in causing crowding to MALBEC and WAITOKI AHI which was checked.

Submissions for Decision:

Mr Williamson demonstrated the video films which showed ZAHTUI (Mrs T Thornton) racing in a 6 wide position approaching the 1800 metres.  On the inside was SHOOTING DAGGERS (Mr D Nolan) and directly inside him was MALBEC (Mr J Collett).  Mr Williamson submitted that Mrs Thornton allowed her mount to shift in when insufficiently clear of SHOOTING DAGGERS which caused him to move in and take the line of MALBEC who in turn was forced in to WAITOKI AHI which received quite a sharp check.  Mr Williamson conceded that SHOOTING DAGGERS did lay in slightly and contributed to the interference. 

Mr M Cameron (WAITOKI AHI) was called and told the hearing he did receive pressure from MALBEC on his outside which was approximately 1 length in front of him.  He said this caused him to check out of it. 

Mr J Collett (MALBEC) said he also received pressure from the outside caused by SHOOTING DAGGERS taking his line when only 3/4 of a length clear of him.  He said he had no option but to move in.

Mr D Nolan (SHOOTING DAGGERS) was then called and confirmed that he received pressure from Mrs Thornton on his outside and approximately 1/2 a length in front of him.  He said this forced him inwards and he was unable to relieve the pressure on the runners on his inside.  In answering a question from Mrs Thornton he admitted there was no contact between their 2 mounts and conceded his horse was laying in slightly. 

Mrs Thornton in her submissions believed the films had been badly read and Mr Nolan had used her.  She reiterated there was no contact and denied putting pressure on Mr Nolan.

Mr Oatham in summing up said the 3 riders inside of Mrs Thornton all said they had received pressure from the outside.  He said the films clearly showed there was insufficient room for the 4 runners on Mrs Thornton's inside to maintain their rightflul line of running once she started to move in.  Mr Oatham said something had to give as a result and this was WAITOKI AHI throwing his head in the air as a result of being checked sharply.  He submitted that Mrs Thornton ended up 3 wide when she needed to be 5 wide.  He conceded there was some mitigation through SHOOTING DAGGERS laying in contributing to the interference.

Reasons for Decision:

The committee carefully considered all evidence as presented and reviewed the films several times. It was evident that at the initial stages of the interference, SHOOTING DAGGERS was laying in slightly while free of pressure from ZHATUI. This did cause Mr Collett to receive pressure from Mr Nolan on his outside while trying to maintain his line.  However as the horses approached the point of the turn the films showed WAITOKI AHI who was racing on the rail receive a sharp check.  The committee is satisfied this was caused by Mrs Thornton allowing her mount to shift in from a 5 wide position to one of 3 wide when insufficiently clear of Mr Nolan on her inside.  This caused tightening to Mr Nolan forcing him inwards with further crowding to Mr Collett and Mr Cameron who had to check sharply.  Mrs Thornton was not the required distance clear when moving in. 

Submissions for Penalty:

Mr Oatham stated that Mrs Thornton had a very good record with one charge in the last 12 months.  He conceded there were some mitigating factors as mentioned earlier and submitted her breach today was in the low to mid range.

Mrs Thornton said she rode throughout the North Island and had commitments up to and including 1 August. 

Reasons for Penalty:

The committee considered submissions on penalty form Mr Oatham and Mrs Thornton.  In mitigation Mrs Thornton has a very good record and the racing behaviour of SHOOTING DAGGERS did contribute slightly to the interference.  However WAITOKI AHI did receive a sharp check due largely to Mrs Thornton moving in when insufficiently clear.  The committee finds Mrs Thornton's breach to be at the lower end of carelessness.
