Facts:

Mr Wallis, Stipendiary Steward, alleged that Mr N Williamson (TRIROYALE BRIGADE) used his whip in an excessive manner over the final 400 metres of race 9, the MCDONALD EXCAVATING /THE ROADING COMPANY MOBILE PACE.

Rule 869 provides as follows:

(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

The Use of the Whip Regulations provide:

(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Wallis demonstrated on the videos that the respondent used his whip 12 times in the last 400 metres.

Mr Williamson has signed the information stating he admits the breach and does not wish to be present.

The count for Mr Williamson is 12. Mr Wallis tells us Mr Williamson has agreed that this is the number. A reset period of 6 months or 200 drives (whichever comes first) applies in respect of all non-serious harness breaches. Mr Williamson is a busy driver and has had 251 drives since his previous breach.

The penalty is determined by a sliding scale. Where the number of strikes is between 11 and 13, and it is a first offence, as this breach is deemed to be, it is $200.
