SEQUOIA is therefore disqualified from the race.

Authority was given for dividends and stakemoney to be paid in accordance with the amended placings.

Facts:

Following the running of Race 3, the GRASS TRACK RACING @ TE AWAMUTU 20th JAN TROT 2200m, an Information instigating a protest was lodged by Mr Muirhead. He alleged that the horse SEQUOIA which finished in 4th place broke in excess of 150metres over the initial stages of the race.

The Judges placings were :

1st - SWINGING

2nd - PHOEBE GEM

3rd - AMABEDE

4th - EQUOIA

5th - SECRETOFTHE SEA SMILE

6th - JEWEL OF SHEBAR

Rule 870(3) provides that 'Any horse which breaks from its gait shall promptly regain its proper gait'.

Mr D McGowan, trainer of the horse SEQUOIA and representing its connections was not present at the hearing. He had, however endorsed the Information with the notation 'I do not contest the protest' and signed it accordingly.

Submissions for Decision:

Using the films Mr Muirhead identified SEQUOIA at the start of the race, which was at the beginning of the home straight. As the starter released the field, SEQUOIA went into a break, and continued on in a gallop until past the finishing post on the first occasion, a distance of at least 200 metres. The horse eventually went back into a trot and finished in 4th place. Mr Muirhead stated that the horse was in breach of the Rules and Regulations and asked that it be disqualified from the race.

Reasons for Decision:

This is an un-contested protest. The horse SEQUOIA was clearly in a gallop in excess of 150 metres from the start of the race and is therefore in breach of the Rules.
