Alleged excessive use of the whip
Facts:
Following the running of Race 1, the Joiners Shop Trot, an Information was filed by Stipendiary Steward Mr N. M. Ydgren against Open Horseman Mr P. C. Nairn alleging a breach of Rule 869(2)(a) in that he used his whip excessively.
The charge reads as follows:
“I the above named informant allege that the above named Respondent committed a breach of Rule 869(2)(a) (in that) you used your whip in a manner which Stewards deem to be excessive in the run home of Race One when driving ”Sent Again”.
Rule 869(2)(a) reads as follows:
“(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.”
Mr Nairn had indicated on the Information that this breach of the Rules was admitted, and he had previously informed the Stipendiary Stewards that he did not wish to attend the hearing.
Submissions for Decision:
Mr Ydgren gave evidence and used video coverage to show that Mr Nairn had used his whip on about 24 occasions in the run home, at which time “Sent Again” was in contention, eventually finishing in 3rd place.
Reasons for Decision:
As Mr Nairn had admitted this breach it was found to be proved in accordance with Rule 1111(1)(d).
Submissions for Penalty:
In relation to penalty Mr Ydgren advised that Mr Nairn had one previous relevant breach of this Rule back in March 2012 when he was fined $200-00. Mr Ydgren also advised that earlier this month new “Use of Whip” guidelines had come into effect for the guidance of drivers. Mr Ydgren said that it had been discussed by the Stipendiary Stewards and decided that all drivers should start with a “clean slate” for any breaches committed from that point on. Chief Stipendiary Steward Mr McIntyre confirmed this.
Mr Ydgren made submissions that as Mr Nairn had admitted this breach a fine of $200-00 should be imposed.

We took into account Mr Nairn’s admission of this breach, and taking all other matters into account decided that a fine of $200-00 should be imposed in this case.
