Facts:

Following the running of Race 1 (YEALANDS FAMILY WINES MAIDEN 2100m), Information A8830 was filed with the Judicial Committee. It alleged a breach of Rule 636(1)(d) and stated that D Turner “failed to ride his mount TO SIR WITH LOVE out to the end of the race when a reasonable chance of finishing in a higher placing.”

Rule 636(1)(d) states:
A person:
(d) being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.

Mr Turner confirmed that he understood the rule and admitted the breach.

Using the side-on and head-on films Mr Goodwin identified TO SIR WITH LOVE racing initially at the front of the field in the run home. Mr Turner was observed to noticeably relax his ride over the final stages. While it appeared that TO SIR WITH LOVE had come to the end of its run, Mr Goodwin submitted that Mr Turner still had an obligation to ride out fully when he was able to. As a result of his actions, he had been beaten by WINEHOUSE which was positioned to TO SIR WITH LOVE’s outside, by a nose margin.

Mr Turner confirmed that he had simply sat up on his ride over the concluding stages and had been beaten by a slim margin despite trying to give his horse it’s best possible run. He said he had no excuses to offer.

Submissions for Penalty:

In presenting penalty submissions, Mr Goodwin identified that Mr Turner had a clear record under this rule, and submitted a fine of $300, with no increase in that quantum being sought. He also identified that the prize money for fifth placing was $250.

Mr Turner had no submissions on penalty to make. 

Reasons for Penalty:

The Committee considered the submissions placed before it. It is clear that Mr Turner relaxed his mount over the final stages of the race, which had cost him fifth position by the barest of margins. It was clear that there was a reasonable chance of TO SIR WITH LOVE finishing in fifth position if he had continued to ride his mount out. Mr Turner has accepted this as well.

The JCA Penalty Guide identifies a $300 fine starting point for failing to retain fifth placing. When we consider Mr Turner’s admission of the breach and his record under this rule, we consider a modest reduction as appropriate.
