The Committee ruled that horse No.2, NEEDASTAR, had been prevented from taking an effective part in the race due to a mechanical failure of its starting stall. It was ordered that it be declared a non-starter.
It was further ordered that dividends for the race be amended accordingly.
Facts:
Following the running of Race 2, the Paul Summerfield Plumbing Open Handicap, an information was filed by Stipendiary Steward, Mr M Zarb, requesting a ruling under Rule 632 as to whether NEEDASTAR (D Prastiyou) should be declared a non-starter “in that whether NEEDASTER was affected by the starting gate not opening”.
Mr D Crozier, trainer of NEEDASTER, was present at the hearing of the information along with jockey, Mr D Prastiyou, and owner, Mr T Mills.
Rule 632 provides as follows:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.

Mr Zarb showed head-on and side-on video replays of the start of the race, a 2100 metres Open Handicap event. He pointed out NEEDASTAR, ridden by Mr Prastiyou, drawn the number 2 gate in the 7-horse field. Mr Zarb submitted that the Stewards were seeking a ruling that NEEDASTER, who finished in 5th place, be declared a non-runner. He showed the gate of NEEDASTAR closed when all other gates were seen to be open when the start was declared. Mr Zarb stated it was clear on the films that the gate on NEEDASTER’s stall was very slow to open and denied the horsed a fair start.
Mr Crozier said that it was clear on the films that the gate had not opened correctly and as the horse was normally a leader in his races, this incident had prevented NEEDASTAR the opportunity to leave the gate quickly and race in his normal position. In answer to a question from the Committee, Mr Prastiyou, submitted that NEEDASTER lost at least 2 lengths at the start. Mr Mills stated that even though the race was a 2100m race, NEEDASTER was a natural leader and did not get the opportunity to take up his normal position in the running of the race. He also stated that once NEEDASTAR was denied a fair start, the punters and owners were also denied a fair opportunity with their investments.
Reasons for Decision:
The Committee was satisfied that there had been a mechanical failure of the starting stall of NEEDASTAR, in that it failed to open simultaneously with the other stalls. As a consequence, NEEDASTAR was slow to begin, losing at least 2 lengths at the start, which prevented it from taking an effective part in the 2100 metres race.
