Mr Dunn having admitted the breach, the charge was found proved. 

Penalty:

Mr Dunn was fined the sum of $150.00.  

Facts:

Following the running of Race # 5 the Waiponamu and Waimea Contracting/ Gordon Sutherland Memorial Trot an information was filed by Stipendiary Steward Mr C Allison alleging that Mr D Dunn (EXPERIMENT), when improving to the inside of DAVEY’S GIFT (M Williamson), failed to ensure that his sulky did not protrude inside the marker line.

Mr Dunn was not present at the hearing but had indicated that he had admitted the charge.

Rule 869 (7A) (b) provides as follows;

(7A) Every Horseman who moves inwards shall ensure. 

(b) That any part of the sulky does not protrude inside the marker line.

Mr Allison showed video replays of the incident from several angles with approximately 400 metres to run.

Mr Allison pointed out that Mr Dunn has moved inside DAVEY’S GIFT when there was “marginally” enough room to do so, but as a result his sulky has come inside the marker line for a short distance.   

Submissions for Penalty:

Mr Allison informed the committee that Mr Dunn had no previous breaches of this rule in the past 12 months.

Mr Allison also stated that Mr Dunn was New Zealand’s leading driver and busiest driver.

Mr Dunn had 1029 drives in the 2013/2014 season and has had 593 drives in New Zealand this season.

Mr Allison submitted that the breach of this rule was at the low end of the scale and that Mr Dunn should also be given some credit for his early admittance of the breach. 

Reasons for Penalty:

In determining penalty the committee had regard to the starting point of a $200 fine or four drives as provided in the JCA Penalty Guide.

Mr Dunn's outstanding driving record and early admission of the breach along with the level of offending to be at the low end of the scale were mitigating factors warranting a $50.00 reduction.
