As Ms R Myers has admitted the breach the Committee finds the charge proveD.

Penalty:

The Committee believes a suspension is the appropriate penalty and Ms R Myers is suspended from the close of racing on Saturday 31 December 2011 up to and including Friday 6 January 2012 (6 days).

Charge:

Following the running of Race 3 a protest was lodged by the 4th placed horse against the 2nd placed horse ridden by Ms R Myers. The protest was upheld and Ms R Myers’ horse was relegated to 4th. The Stipendiary Stewards then charged Ms R Myers with careless riding in that “Over the final stages R Myers permitted her mount “McLaren” to shift out causing “Princess Katie” to be tightened and checked”.

Rule 638(1)(d) was read and confirmed and understood by all parties.

Facts:

Stipendiary Steward Mr R Neal referred to evidence given at the previous hearing in relation to the protest involving this incident and for the benefit of Ms Northcott the head on and side on films were shown.

He pointed out that as Ms R Myers was travelling inside the final 250m her horse was under an increasing vigorous ride with Mr Sweeney travelling just in behind her until a gap started to open up at approximately the 200m mark. He said as Mr Sweeney was attempting to find clear room on the outside of Ms Myers she had continued to move quite sharply outwards and taken his rightful running line causing him to abruptly check his horse and lose all momentum.

Ms R Myers stated “McLaren” had hung out all the way up the straight and she had used the stick to try and straighten him up but it hadn’t worked. She said she readily admitted the breach of the Rule and was not aware Mr Sweeney was going for the gap on her outer when the incident happened.

Submissions for Penalty:

Mr Neal, in presenting Ms R Myers’ riding record said she had been charged twice under this rule in New Zealand in the last 12 months (18 November and 16 April). She had also been suspended for 1 charge of careless riding whilst riding in Australia in July. He said her riding record was good for the number of rides she has and that she rides throughout the country. He said the Stewards considered the degree of severity of the interference to be in the mid to upper end as the check to Mr Sweeney was a significant one. He said the Stewards submitted a period of suspension was an appropriate penalty and on this occasion a penalty of 6 days was appropriate.

Ms R Myers made a request for a 7 day deferment as she had made commitments to ride at the Stratford meeting on 31 December. When questioned on her expected riding engagements after that date she said her uncle - trainer Mr K Myers – had a team of horses currently racing in the South Island and she was hoping to ride those horses. She also said she was hoping to ride in the Railway Handicap at the Auckland meeting on 1 January.

Reasons for Penalty:

In reaching a decision on penalty we have taken a starting point of 5 days and taken into account that Ms R Myers did admit the breach and that she has a relatively good riding record considering the number of rides she has (she is one of the top 10 busiest riders in the country). However, the aggravating factors are that the Committee assesses the severity of the interference to be at the high end because she continued to ride with vigour when shifting outwards over 14-15 strides causing the abrupt check to Mr Sweeney and that she admitted she was not aware of Mr Sweeney on her outside at any time. Finally and significantly the incident resulted in Ms R Myers being relegated from 2nd placing to 4th placing which had a financial impact on the owners of “McLaren” and the betting public as place, quinella, trifecta, first four and doubles dividends were all amended following the change of placings.
