Facts:
Following the running of race 12 The Invercargill Partsworld Mobile Pace, an information was filed by Stipendiary Steward Mr C J Allison against Licensed Junior Driver Mr R T Mc Ilwrick, alleging a breach of Rule 869(3)(b) in that "with approximately 350 metres to run Mr R Mc Ilwrick (SWEET P) shifted ground inwards checking SUPREME SIGN (C Ferguson)".
Mr Mc Ilwrick was present at the hearing of the information and he indicated that he admitted the breach of the rule.
He was assisted at the hearing by Licensed Open Horseman Mr J Cox.
Rule 869 provides as follows:
(3) No horseman in any race shall drive:-
(b) Carelessly
Submissions for Decision:
Mr Allison stated that the Stewards were alleging that, with approximately 350 metres to run, Mr Mc Ilwrick (SWEET P) shifted ground inwards checking SUPREME SIGN (C Ferguson).
Mr Allison showed video replays of the alleged incident pointing out where in his opinion Mr Mc Ilwrick shifted inwards when there was insufficient room.
Mr Allison also commented that the horses were running in the rear of the field and that neither horse had a chance to finish in a dividend bearing place.
Mr Cox in supporting Mr Mc Ilwrick agreed with the video evidence and commented that Mr Mc Ilwrick in his opinion made a slight error of judgement but that in doing so his actions had not affected the chances of either horse.
Reasons for Decision:
After hearing from Mr Mc Ilwrick and Mr Cox and viewing the video evidence presented by Mr Allison, the Committee found the charge proved. It was clear that Mr Mc Ilwrick's horse had moved inwards when not sufficiently clear of SUPREME SIGN.
Submissions for Penalty:
Mr Allison told the Committee that he believed the breach was at the lower end of the scale, that it was Mr Mc Ilwrick's first breach of any rule and that he had only 46 race day drives in his career to date.
Mr Allison again stated that neither horse had its chances affected in any way.
Reasons for Penalty:
The Committee agreed that the breach was very minor and took into account Mr Mc Ilwrick's early admission of the breach and the fact that it was his first offence.
