As Mr Yanagida admitted the breach the Committee found the charge proved. 

Penalty:

The Committee granted Mr Yanagida a deferment to his suspension pursuant to Rule 1106(2).

Accordingly, his Licence to ride in races is suspended for a period of 4 days commencing after racing on 5 June 2021 and concluding after racing on 10 June 2021. In addition, we impose a $500 fine.

Facts:

This charge arises from the running of Race 10, A Benchmark 65, 1600m event. Stipendiary Steward, Mr Coles filed an Information pursuant to Rule 638(1)(d) alleging the rider of GRACIANO (T Yanagida), ”allowed his mount to shift out near the 50m when insufficiently clear of SAVAPPIEL, which was checked”.

Mr Yanagida acknowledged he understood the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using the available race films Mr Coles demonstrated the incident and identified the horses and riders concerned; GRACIANO (T Yanagida) and SAVAPPIEL (S Spratt).

Mr Coles said that at about the 100m Mr Yanagida’s mount (GRACIANO) was to the inside and approximately half a length ahead of SAVAPPIEL. He said that while GRACIANO was being ridden with the whip it commenced an outward shift. He said that just prior to the interference Mr Yanagida had the opportunity to straighten his mount but continued to apply the whip in a competitive finish, and checked SAVAPPIEL.

In response Mr Yanagida said that his horse shifted slightly but then shied at the winning post checking SAVAPPIEL. He said that he didn’t realise there was a horse to his outer until he heard the rider yell out.

Mr Gillies, who was assisting Mr Yanagida, noted that the shift was worst at the very end and Mr Yanagida should have straightened.

Submissions for Penalty:

Ms Selvakumaran produced Mr Yanagida’s riding record which indicated 3 previous breaches under the careless riding Rule in the last 12 months and said that Mr Yanagida was a relatively busy rider.

Ms Selvakumaran said Stewards assessed the level of carelessness to be in the mid range and if not for the interference SAVAPPIEL may have finished closer than it did.

In response Mr Yanagida said that he felt the interference that occurred was at the low level and requested that any proposed suspension start after 5 June.

Reasons for Penalty:

After considering the submissions and reviewing the Race film the Committee determined Mr Yanagida’s carelessness to be just below mid - range and adopted a 4-day (suspension) and $250 (fine) as the starting point.

The Committee viewed the head-on, side-on and back-on films which established that Mr Yanagida allowed his mount to shift out when riding in a competitive finish. It was of the Committee's opinion that Mr Yanagida, would have known that SAVAPPIEL was to his outer as they had raced beside each other for most of the final straight, and that Mr Yanagida did have an opportunity to straighten his mount prior to the interference.

Mr Yanagida’s riding record was assessed as being a neutral factor.
