As Ms Jones has admitted this breach we find the charge proved.

Penalty:

Accordingly we impose a period of suspension on Ms Jones, to commence following the conclusion of racing on 26 December at Ellerslie and concludes following racing on 30 December 2015-3 days.

Meetings involved in this suspension are:

27 December - Rotorua

28 December - Ellerslie

30 December - Taupo

Facts:

Following the running of Race 4,  the THEBESTLITTLEBOOKSTORE.CO.NZ.1400, an Information was laid by Mr Oatham alleging that near the 1100 metres, Ms Jones riding THE DOM allowed her mount to shift in when not sufficiently clear of BIGSIE, ridden by Ms D Johnson, which was checked.

Ms Jones was present at the hearing and acknowledged that she was conversant with the Rule and that she admitted the breach. She was assisted at the hearing by Mr N Harris, Apprentice Riders Mentor. Ms Jones told the Committee that she and Mr Harris had viewed the film of the incident prior to the hearing.

Rule 638(1)(d) provides ' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.

Using the available video films, Mr Williamson demonstrated the incident. He pointed out that THE DOM was in a 3 wide position with BIGSIE inside her in a 2 wide position. Ms Jones then allowed her mount to shift in towards BIGSIE when she was barely a length clear of that horse. This caused Ms Johnson to take a firm hold of her horse to avoid THE DOM, resulting in the horse inside her (SUGGESTIONS, ridden by Mr V Colgan ) to be placed in restricted room. In turn this caused the horse inside SUGGESTIONS (TE WAEWAE BAY, ridden by Mr L Magorrian ) to over-race. However it should be noted that that horse had been racing fiercely prior to this incident.

Ms Jones said she had looked around prior to shifting inwards but had been unware of Ms Johnson's mount being in close proximity. She said THE DOM had been racing greenly before this incident and added that she knew she had been responsible for putting pressure on Ms Johnson.

Mr Harris said Ms Jones had checked around her prior to shifting in but had clearly miscalculated Ms Johnson's position and had not been the required distance clear of her mount.

Submissions for Penalty:

Mr Oatham produced Ms Jones' riding record. He submitted that she had a good record with 2 prior breaches of the relevant Rule in the past 12 months, one of these being almost 12 months ago. He submitted that Ms Jones was having a successful season to date, and that she travelled to most meetings throughout the North Island. Mr Oatham stated that in the Stewards' opinion this breach was at the low end on the scale of seriousness, that Ms Jones had admitted the breach, and felt that a term of suspension would be an appropriate penalty.

Ms Jones told the Committee she had rides at the upcoming meeting at Ellerslie on 26 December and could start a suspension after that meeting.

Reasons for Penalty:

The JCA Penalty Guide suggests a 5 day suspension as a starting point for breaches of this Rule. Ms Jones has admitted this breach, has a very good record this year relative to this Rule, and we accept that this breach falls towards the lower end of the scale. Given these substantive mitigating factors the Committee believes that this breach can be dealt with by way of a 3 day suspension to Ms Jones' riding licence.
