As Mrs Thornton admitted the breach, the charge was found to be proved.

Accordingly after taking all the above factors in to account we impose a fine of $200.00.

Charge:

 

Following race 7 an information was lodged alleging a breach of rule 610 (4) in that Mrs Thornton was in possession of a body protector which has been modified.
 

Facts:

 

Mr Williamson told the committee that Mrs Thornton entered the Stewards room in an unrelated matter wearing a modified body protector. He displayed the vest and pointed out where the lower section of pads that had been removed.
 
Mrs Thornton admitted she used the vest for track work. She had no problem with Mr Williamson retaining the body protector as it was non compliant. She admitted to the committee wearing the modified body protector to keep warm between races. She does own and ride in races wearing a compliant Vipa vest which the committee observed.

Submissions for Penalty:

 

Mr Williamson submitted that Mrs Thornton had a clear record under this rule and admitted the breach. He said there was no reason to deviate from previous penalties which have resulted in a fine of $200.00.
Mrs Thornton said she would have preferred a warning.
 

Reasons for Penalty:

 

The committee carefully considered all the evidence and submissions as presented. We also had the opportunity to inspect the vest and the modifications made to it.
Mitigating factors are Mrs Thornton’s admission of the breach, no previous breaches of the rule.
The aggravating factor is Mrs Thornton had in her possession a body protector that had been modified. The committee explained to Mrs Thornton that safety was paramount and we expected her as a senior rider to be fully aware of the regulations.
