As Mr Cameron admitted the breach the Committee found the charge proved.

Penalty:

The Committee grants a deferment to Mr Cameron’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Cameron had his license to ride in races suspended for a period to commence after racing on 9 June and conclude after racing on 16 June 2018.

Facts:

Following the running of race 6, West Brook Wines 1360, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Cameron allowed his mount SOCIALLY EXCITED to shift in when not clear of PACQUIAO which was crowded and checked near the 1300 metres.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Cameron acknowledged that he understood the Rule and confirmed that he admitted the breach.

Mr Coles demonstrated the incident using the available video footage. He identified that near the 1300 metres Mr Cameron endeavoured to get closer to the running rail and in doing so he got into the running line of PACQUIAO. He said when that runner was crowded and checked Mr Cameron was only a bare length clear.

Mr Cameron said that he thought he was clear when he allowed his mount to shift in.

Submissions for Penalty:

Mr Williamson produced Mr Cameron's record which showed 4 previous breaches under this Rule in the last 12 months. He said his record was a neutral factor and the breach was an error of judgement by Mr Cameron. He said a low end suspension would be appropriate.

The Committee granted an adjournment so Mr Cameron could discuss his upcoming engagements with his Agent.

Mr Cameron advised the Committee that he had firm engagements on 9 June and sought a deferment to his proposed suspension.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The video films showed that Mr Cameron allowed his mount to shift in 1 horse width shortly after the start when not the required distance clear of PACQUIAO. This result in that runner being crowded and checked. The Committee deemed the level of carelessness as low range and the JCA starting point of 6 national riding days was adopted.

There were no aggravating factors.

The mitigating fact was Mr Cameron’s admission of the breach for which he was afforded a 1 day reduction in penalty.

The Committee deemed Mr Cameron’s record to be fair and a neutral factor. We took into account that Mr Cameron is a busy rider and NZTR records show that he has had 553 rides to date this season.

After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
