As Ms Whelan has admitted the charge it is therefore deemed to be proved.
Penalty:
Careful consideration has been given to the question of penalty. We take as a starting point a suspension of 5 days. Against that starting point, we are obliged to give consideration to the mitigating and aggravating features.
The mitigating features are:
- The early admission of the charge;
- Ms Whelan's overall co-operation with the Stipendiary Stewards;
- Her good record , having been suspended only twice in her riding career which we accept comprises in excess of 400 rides;
The mitigating features allow us to discount our starting point by 2 days.
However, against that we must take into account the aggravating features which we find are:
- The fact that Ms Whelan has only recently come off a 4 day suspension which was imposed on 13th October 2011;
- That the interference caused clearly deprived "Alpine Heights" of its racing line. Ms Whelan was not her own length and another horse length clear and thus we draw the conclusion that Ms Whelan's degree of carelessness was mid range.
The aggravating features add a day to the discounted penalty of 3 days making the period of suspension, 4 days.
Ms Whelan is accordingly suspended from race riding from the conclusion of racing on Tuesday 1st November 2011 until the conclusion of racing on Sunday 6th November 2011. That period of suspension encompasses meetings at Paeroa (2nd), Poverty Bay (4th), Canterbury Jockey Club (5th) and Poverty Bay (6th).
Charge:
Alleged that Lisa Whelan allowed her mount to shift wider on the track near the 100 metres crowding the running of "Alpine Heights" which had to be checked and lost running to which it was entitled.
Prior to the hearing commencing, Ms Whelan was advised that she was entitled to have a Licence Holder present to assist. Ms Whelan confirmed to the hearing that she had taken advice from two trainers prior to deciding her plea and that as a consequence, she did not require a licence holder to be present to assist.
Facts:
With approximately 100 metres to run in the "Canterbury Equine Clinic Rating 75", Ms Whelan was racing approximately one horse width off the rails tracking "The Goddaughter" which at that time was running in second position. At that point, Ms Whelan angled her mount outwards at the time that "Alpine Heights" was improving. "Alpine Heights had a clear running line ahead of it but Ms Whelan's mount went on to the line of "Alpine Heights" when Ms Whelan was not her own length and another length clear, with a resultant check to "Alpine Heights". The incident was demonstrated on the video coverage of the race, with the Committee being shown the incident from the head-on and side-on camera views
Ms Whelan did not dispute the facts as outlined by the Stipendiary Stewards. She did observe that "Alpine Heights" had been "lugging in" earlier in the race.

Mr Ray advised the hearing that Ms Whelan was a busy and promising apprentice rider, who had some 400 rides to her credit. In her racing career, she has been suspended twice for careless riding, in May 2011 for 3 days and as recently as 13th October 2011 for 4 days. Mr Ray said that Ms Whelan was always co-operative wth the Stipendiary Stewards and always presented well. Mr Ray submitted that a suspension of perhaps 3 days was appropriate.
Ms Whelan did not have any submissions to make on the question of penalty.
