The protest is upheld and Carlton is disqualified from the race.

Carlton finished 6th in the race. Doff Your Cap, who is also disqualified from the same race for the same breach, finished 5th. There were only six starters. Accordingly, the first four placings remain as they were past the post.

Facts:

Following the running of the Haras Des Trotteurs 2YO Mobile Trot, an information instigating a protest was lodged by Stipendiary Steward Mr S Renault against the sixth placing of Carlton on the grounds that it broke near the 600 metres and broke in excess of 150 metres in breach of the Breaking Horses Regulation.

The protest was uncontested, disqualification accepted and Mr May confirmed to Mr Renault that he would not appear at this hearing.

Rule 870(3) provides that “any horse which breaks from its gait during a race shall promptly return to its correct gait.

The Breaking Horses Regulations provide: "that any horse which breaks from its gait and gallops in excess of 150 metres in a race shall be deemed to be in breach of Rule 870(3) and may be disqualified from the race."

Submissions for Decision:

Mr Renault replayed the race video and showed Carlton break near the 600 metres and gallop for approximately 300 metres before returning to its gait and completing the race.

Mr Renault submitted that Carlton was in breach of Rule 870(3) and should be disqualified from the race.

Reasons for Decision:

The Committee was satisfied that CARLTON broke near the 600 metres and broke in excess of 150 metres in breach of the Breaking Horses Regulation.
