Following the running of Race 1, Stipendiary Steward Mr J Muirhead filed Information A2391 with the Judicial Committee. It alleged a breach of Rule 870(3) in that "RICH EARL placed 4th, galloped in excess of 150m at the start".

Rule 870(3) states: "Any horse which breaks from its gait shall promptly regain its proper gait".
The Breaking Horse Regulations state: "(a) Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait".
Mr F Cossey was present at the hearing and confirmed that he did not contest the Information.
Submissions for Decision:
Using the head-on film, Mr Tidmarsh identified RICH EARL shortly after the start of the race. Mr Muirhead submitted that the film clearly showed the horse galloping from the 2600m start, for a distance of at least 300 metres. Mr Muirhead asked the committee to give favourable consideration to disqualifying RICH EARL.
Mr Cossey agreed with this and stated that he had nothing further to add.
Reasons for Decision:
The films clearly indicated RICH EARL breaking at the start for a distance of at least 300 metres. This was clearly in breach of Rule 870(3). Accordingly, the committee considered it appropriate to exercise the discretion afforded to it under the provision of Rule 1003(2).
