Facts:

Following the running of Race 2 (NZB Insurance Pearl Series Race) Information No A14115 was filed with the Judicial Committee. It was alleged by the Informant that Ms Schofer had attempted to weigh out for JAXX BE NIMBLE minus leathers and irons.

Ms Schofer in the presence of Ms Clapperton said that she admitted the breach and understood the Rule.

Mr Goodwin said that the Clerk of the Scales reported that when Ms Schofer attempted to weigh out she did so minus the leathers and irons.

Mr Goodwin said that when questioned Ms Schofer said that she left the leathers and irons off as she was .5kg overweight with them on.

Ms Schofer said that she had a weigh in the morning and thought her weight was alright. She then went for a walk, re-weighed and found that she was a little heavy, but that it was too late then to do anything about it.

Submissions for Penalty:

Mr Goodwin said that this was the first charge under Rule 649(1)(a) for Ms Schofer, but that she has had a number of weight issues.

Ms Clapperton said that Ms Schofer’s minimum weight has recently been lifted to 56kg.

Reasons for Penalty:

There is not a JCA penalty starting point for a breach of Rule 649(1)(a). Accordingly, it is fact dependent.

The Committee in determining a suitable penalty took into account Ms Schofer’s record, the admission of the breach together with the relative seriousness of the act. The penalty imposed should be sufficient to suitably penalise the Respondent and also deter others.
