Charge:

Following race 2, an information was filed pursuant to Rule 638(3(b). The informant, Mr Williamson, alleged that Mr S Doyle used the whip in an excessive and unnecessary manner on EL VIENTO.

Facts:

Mr Williamson demonstrated the incident by using all the available films. He pointed out to the committee that Mr Doyle was using the whip from the 900 metre mark. He said it is clear on the film that EL VIENTO was not responding at the 400 metre mark to his strong ride. However, Mr Doyle continued to use his whip in the final straight when the horse was well out of contention.

Mr Doyle informed the committee he was disappointed with his actions when viewing the films. He further explained that EL VIENTO was on its last chance and he was instructed to ensure the horse was well tried.

Submissions for Penalty:

Mr Williamson produced Mr Doyle's record which showed no previous breaches of this rule in the last 12 months. He said that Mr Doyle's level of carelessness was at the low end. He submitted an appropriate penalty was a fine in the range of $100 - $200.

Mr Doyle submitted after viewing the films his actions were unnecessary and he would prefer a fine.

The committee carefully considered all the evidence and submissions presented. The mitigating factor is Mr Doyle's admission of the breach and his clear record. However, this has to be balanced against his actions, which the committee assess as unnecessary as the horse was not making any progress in the final straight.
