Facts:
Following the running of race 5, Dominator Garage Doors Tauranga 1200, an Information was filed Instigating a Protest pursuant to Rule 642(1).The Informant, Mr C Dell ,alleged that ROCANTO or its rider placed 1st by the Judge interfered with the chances of his mount GO NICHOLAS placed 2nd by the Judge.
The interference is alleged to have occurred in the final straight.
The Judge's placing are as follows:
1st - No. 4 ROCANTO
2nd - No. 7 GO NICHOLAS
3rd - No. 12 LIGHT SHADOW
4th - No. 5 BRIGHTON
The official margin between 1st and 2nd is a nose.
Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
Submissions for Decision:
Mr Dell stated that ROCANTO shifted out when being ridden with vigour and dictated his running line. He said although ROCANTO did not touch GO NICHOLAS it resulted in his mount being pushed out 3 to 4 horse widths.
Ms Hale said it was clear on the head – on film that ROCANTO dictated GO NICHOLAS off its running line. She noted the margin between the 2 horses at the finish is only a nose.
Mr Marsh stated that no contact occurred between the 2 horses. He identified that Mr Dell did not stop riding GO NICHOLAS in the final straight. He added that in his view the protest is frivolous.
Mr Mazurki acknowledged that ROCANTO did shift out but pointed out on the video films that he straightened his mount. He confirmed that no contact occurred between the 2 horses.
Mr Williamson on behalf of the Stewards submitted that near the 100 metres ROCANTO did move out but stated no contact occurred. He identified that GO NICHOLAS shifted away from ROCANTO near the finish line and doubted if any interference had occurred.
Reasons for Decision:
The Committee carefully considered all evidence and submissions presented and reviewed the video footage several times. We established that inside the final 100 metres ROCANTO shifted out 2 to 3 horse widths when being placed under pressure. At that point ROCANTO was racing in first position and we identified that Mr Mazurki did take corrective action to avoid any interference to runners on his outside. While we acknowledge that GO NICHOLAS did shift away from ROCANTO it is clearly evident this did not cost that runner any momentum and notably Mr Dell is not inconvenienced in riding his mount out to the finish line. The Committee is of the opinion that the outward shift that occurred did not have a bearing on the outcome of the race and accordingly there are insufficient grounds to justify a change of placings.
