The protest is dismissed.

The Judge's placings are confirmed and dividends are to be paid accordingly.

Facts:

Prior to the hearing commencing, Mr Hannam advised that he was representing the connections of his horse, as was Mr Walters representing the connections of "Blackberry Punch".

Mr Hannam, the rider of "A Bob Short" told the hearing that as he  rounded the home turn he was racing about five wide with "Blackberry Punch" on his inside. With about 300 metres to go to the finishing post, he said that Mr Walters' mount made contact with his horse, on several occasions and forced him over extra ground. He said that Mr Walters kept the pressure on him, all the way to the post, with contact on a number of occasions, one of which was a "solid bump". At about the 100 metres Mr Hannam dropped his whip which he said was caused by the contact that was made by Mr Walters' mount. From that point on, Mr Hannam had to ride "hands and heels". He said that if he had not dropped his whip, then he would have been more effective in moving his mount forward, and felt that he had been disadvantaged. He described it as a "telling factor" in him losing the race. He therefore considered that "A Bob Short" would have beaten "Blackberry Punch".

The official margin between first and second was half a length.

We were shown the video coverage of the incident which confirmed Mr Hannam's evidence.

Ms P Robson, the trainer of "Blackberry Punch", asked the hearing to note that "A Bob Short" was a much bigger horse that "Blackberry Punch" and that whilst there may have been contact between the two horses, such contact did not have any significant impact on "A Bob Short". There was limited outwards movement caused by the contact. She said that Mr Walters was doing his best to keep his mount going straight. She said that "Blackberry Punch" came away again and won on his merits.

Mr Walters said that "A Bob Short" ranged up alongside of him as if it was going to go past him. He did not use his whip. However, his mount kept on and went away from "A Bob Short".

Mr Neal agreed that there had been contact on several occasions and that Mr Hannam did lose his whip. However the margin at the finish confirmed that Mr Walters mount was "going away". The fact that Mr Hannam lost his whip and the impact of that was something that the committee would take into account.

Submissions for Decision:

Mr Hannam was of the view that the interference caused to his mount and the fact that he dropped his whip as a result of the contact made, had such an impact on his horse that, had such interference not occurred then he would have run the race.

In summary, Mr Walters submitted that he rode on even terms with Mr Hannam, and his horse was "going away" at the finish.

Reasons for Decision:

After giving careful consideration to the evidence and the submissions made by the parties, we find:

  • There was interference caused to "A Bob Short" by "Blackberry Punch" in terms of the definition in Rule 642 (2)(b)(ii);
  • "Blackberry Punch" was "going away" at the finishing line;
  • Mr Hannam dropped his whipped but in our view there was space between the two horses at the time the whip was dropped. As to whether the contact caused Mr Hannam to drop his whip is something we are unsure of and thus, we make no finding on that point;
  • Both riders were racing on even terms for the last 100 metres or so;
  • The official margin at the finish between first and second was half a length.

As a consequence of our findings, we are not satisfied that "A Bob Short" would have beaten "Blackberry Punch".
