Decision:

As Ms Hirini admitted the breach we found the charge proved.

Penalty:

Taking into account all submissions it was the Committee’s opinion that a six-day suspension was an appropriate penalty.

Ms Hirini is therefore suspended from the close of racing on Thursday August 23rd up to and including racing on Sunday September 2nd.

Facts:

Following the running of Race 8 (Sportz Bar 2060), an Information was lodged by Mr Goodwin stating that Apprentice Jockey D Hirini allowed her mount REVOLUTION to shift outwards when not sufficiently clear of CORNERSTONE which was checked.

Mr Goodwin played the films and showed where Ms Hirini took the rightful line of running of Mrs Allpress. Initially Ms Hirini moved inwards to allow Mrs Allpress room on the fence but once Mrs Allpress was established in this position, Ms Hirini drifted outwards and tightened her mount against the fence. Mrs Allpress had to check her mount and move to the inside of Mrs Hirini to gain a clear run.

Mr Thornton, who was assisting Ms Hirini, conceded that there was a degree of carelessness involved in the incident.

Submissions for Penalty:

Mr Goodwin said Ms Hirini had a clear record in regard to careless riding and Ms Hirini confirmed she hadn’t breached this rule within the last year.

The Stewards’ assessed the incident as mid-range and submitted that a suspension in line with the degree of carelessness be imposed.

Ms Hirini said she believed the incident was in the low to mid-range.

Mr Thornton agreed explaining that because Ms Hirini had always maintained forward momentum she considered herself clear of the other horse at the time.

Ms Hirini advised of riding commitments through until Tauherenikau on Thursday August 23rd.

Reasons for Penalty:

The Committee was of the opinion that the breach of careless riding was mid-range. We based this on the fact that Ms Hirini moved outwards several horse widths, while riding with vigour, and at no stage attempted to straighten her mount. Mrs Allpress suffered a loss of momentum and was denied her rightful line of running, being forced to check and come to the inside of Ms Hirini’s mount.

We adopted a starting point of 8 days as outlined for a mid-range breach in the Judicial Committee Penalty Guide. Mitigating factors were Ms Hirini’s admission of the breach, her excellent record and her status as an apprentice rider.
